These terms and conditions constitute a legal Agreement between you and Sennari (“Sennari”). Please read them carefully. SENNARI MAKES NO REPRESENTATION THAT THE PRIZEPLAY OR PLAY4CASH GAMES SERVICE, IN WHOLE OR IN PART, IS APPROPRIATE OR AVAILABLE FOR USE IN YOUR JURISDICTION. IN ANY EVENT, YOU ARE SOLELY RESPONSIBLE FOR SUBMITTING ACCURATE REGISTRATION INFORMATION AND MAINTAINING THE ACCURACY OF THIS INFORMATION ON AN ONGOING BASIS. SUBMITTING MISLEADING, INCOMPLETE AND/OR INACCURATE INFORMATION WILL RESULT IN THE TERMINATION OF YOUR USER ACCOUNT AND FORFEITURE OF ANY PRIZES YOU MAY HAVE WON ON THE SITE. 1)Description of Service: The PrizePlay and Play4Cash games service provides skill based games for use on mobile phones (the “Service”). The games are played by using digital game play tokens that may be purchased from the game menu. The purchase cost of the tokens and any associated service fees will appear on your wireless carrier’s phone bill. These games may reward the user with points for successful play. These points may be redeemed at PrizePlay rewards catalogs for digital prizes such as ringtones, wallpapers, and images delivered via SMS, MMS, WAP and other means of mobile content delivery to compatible mobile devices and, where applicable, physical prizes, which are mailed by common carrier to users. Play4Cash games may be redeemed for cash prizes but not for prizes in the PrizePlay rewards catalogs. 2)Access to the Service: In order to use the Service you must have a mobile communications subscription with a participating carrier or otherwise have access to a mobile communications network for which Sennari makes the Service available, as well as any carrier services necessary to download content, and pay any service fees associated with any such access. In addition, you must provide all equipment and software necessary to connect to the Service, including, but not limited to, a mobile hand set or other mobile access device that is in working order and suitable for use in connection with the Service. You are responsible for ensuring that your equipment and/or software do not disturb or interfere with Sennari’s operations. Any equipment or software causing interference shall be immediately disconnected from the Service and Sennari shall have the right to immediately terminate this Agreement. If any upgrade in or to the Service requires changes in your equipment or software, you must effect these changes at your own expense. Unless explicitly stated otherwise, any new or additional features that augments or enhances the current Service, including the release of new products and services, shall be subject to the terms and conditions of this Agreement. 3)Eligibility: For eligibility to participate in the PrizePlay or Play4Cash games Service you must:
4) Privacy Policy:The www.PrizePlay.com web servers automatically recognize and record the domain name from which you access the Internet and the names of the pages you visit while at the PrizePlay.com rewards catalog website. The PrizePlay.com web servers do not automatically extract or store your electronic mail address (See E-Mail Addresses below). The information automatically recognized and recorded is not personally identifiable and is used to improve the content of the PrizePlay.com rewards catalog web site and make it more useful.
6)Copyright: Sennari, Inc. and its licensors holds the worldwide copyright for all copyrighted and copyrightable materials on the Site, including, without limitation, the Sennari, Inc. trademark, logo, design, text, graphics, forms and any other applicable Materials, including the selection and arrangement of such elements. In addition, the entire Site is copyrighted as a collective work under the United States and other international copyright laws. Sennari, Inc. holds the copyright in the Materials as well as the collective work. The collective work includes works that are licensed to Sennari, Inc. The collective work may also include works that are the property of Sennari, Inc. and its licensors, which are also protected by copyright and other intellectual property laws. 7) Trademarks: All trademarks, service marks, logos, trade names, and any other proprietary designations of Sennari, Inc. used herein are trademarks or registered trademarks of Sennari, Inc. Any other trademarks, service marks and trade names are the trademarks or registered trademarks of their respective parties. BINDING
TERMS AND CONDITIONS: Sennari Entertainment, Inc. will evaluate each validated abuse incident on a case-by-case basis and impose Termination or Suspension at its sole discretion. Sennari Entertainment, Inc. may undertake, at its sole discretion and with or without prior notice, the following enforcement actions described in detail below: Account Suspension: Upon the receipt of a credible and validated complaint, Sennari Entertainment, Inc. may elect to suspend the membership of the user implicated in the abuse. Suspension serves as a "Final" warning and will prevent the abuser from continuing their abusive "Spamming" behavior. The Site reserves the right to lift the suspension of a user at any time, at its sole discretion. Account Termination: Upon the receipt of a credible and validated complaint, Sennari Entertainment, Inc. may immediately terminate the membership of the individual user implicated in the abuse. Termination results in the immediate closure of the account, forfeiture of any funds you may have won or deposited, a prohibition against any future membership, and the user will lose the right to compete in any game play. 15. Reporting Abuse: If you wish to report a violation of our Anti-Spam Policy, please forward all evidence of abuse to: support@sennari.com. Please refer responsibly!
5. Internet: If for any reason the mobile or Internet
portion of the games are not capable of running as planned, including
infection by computer virus, bugs, tampering, unauthorized intervention,
fraud, technical failures, or any other causes beyond the control of
Sennari Entertainment, Inc. which corrupt or affect the administration,
security, fairness, integrity, or proper conduct of these games, Sennari
Entertainment, Inc. reserves the right, at its sole discretion, to disqualify
any individual who tampers with the entry process, and to cancel, terminate,
modify or suspend the contest. In such event, Sennari Entertainment,
Inc. further reserves the right to award prizes to the players with the
most points as of the termination date. Sennari Entertainment, Inc. assumes
no responsibility for any error, omission, interruption, deletion, defect,
delay in operation or transmission, communications line failure, theft
or destruction or unauthorized access to, or alteration of, entries or
transactions. Sennari Entertainment, Inc. is not responsible for any
problems or technical malfunction of any telephone network or lines,
computer on-line systems, servers, or providers, computer equipment,
software, failure of any e-mail entry or transaction to be received on
account of technical problems or traffic congestion on the Internet or
at any Web site, or any combination thereof, including any injury or
damage to participant's or any other person's computer related to or
resulting from participation or downloading any materials in this contest.
Further Sennari Entertainment, Inc. assumes no liability for any losses
related to the above outlined failures or caused by any disconnection
from the games. 11. Prize Substitution: Sennari Entertainment, Inc. reserves the right to substitute a prize of equal or greater value for any prize selected for redemption by you if the prize you selected is not available. Please allow four (4) to six (six) weeks for delivery of physical prizes. Incorrect mailing addresses will result in the return of the physical prize to Sennari Entertainment, Inc. Sennari Entertainment, Inc. will make one attempt to reach you via text message to your phone or email to a valid email address supplied by you as indicated in your PrizePlay account. 12 Expiration of Game Play Tokens: Sennari, Inc. reserves the right to void all game play tokens for any PrizePlay player account if the player has been inactive for three (3) consecutive months. An inactive account is any account in which the PrizePlay Player has not logged in or played any games in three (3) consecutive months.
13 Game Credits: The credits accrued by virtue of playing this game have no actual monetary value and cannot be redeemed or used for any purpose other than for the redemption of prizes made available from the prize catalog while such items are available, by virtue of credits. Sennari does not warrant or guarantee the availability,merchantability,fitness of use or otherwise for any item offered, ordered by or provided for an end user hereunder. 14. Expiration of "Bling" Reward Points: Sennari, Inc. reserves the right to void all "Bling" Reward Points or any other reward points offered by Sennari for any PrizePlay player account if the player has been inactive for three (3) consecutive months. An inactive account is any account in which the PrizePlay Player has not logged in or played any games in three (3) consecutive months. 15. Payment: At its sole discretion, Sennari, Inc reserves the right to pay users who have won a monetary reward from a Play4Cash game 14 days following the end of the month in which the request for redemption was made. You must have a valid Paypal account or create a Paypal account to receive cash prizes otherwise we will send you a substitute prize - see Section 11. Prize Substitution.
16. Maximum Lifetime Prize Value Redemption: At Sennari's discretion, Sennari, Inc. may limit the maximum prize value amount that can be earned over the lifetime of a player account to £450 for any individual account holder. Upon reaching this value, players may continue to play games, earn Bling Reward Points but only use the points to redeem for more game play tokens

The games are played by using digital game play tokens that may be purchased from the game menu. Each game comes with free tokens, once used you must buy new tokens for continued play. The purchase cost of the tokens and any associated service fees will appear on your wireless carrier's phone bill. These games may reward the user with points for successful play. These points may be redeemed at PrizePlay© rewards catalogs for digital prizes such as ringtones, wallpapers, and images delivered via SMS, MMS, WAP and other means of mobile content delivery to compatible mobile devices ("Downloads") and, where applicable, offers physical prizes, which are mailed by common carrier to users. PrizePlay is intended for over 16's only. Play responsibly and always ask the bill payers permission before buying tokens. These games also require internet access, other charges may be incurred via your provider. 2) Access to the Service: In order to use the Service, you must have a mobile communications subscription with a participating carrier or otherwise have access to a mobile communications network for which Company makes the Service available as well as any carrier services necessary to download content, and pay any service fees associated with any such access. In addition, you must provide all equipment and software necessary to connect to the Service, including, but not limited to, a mobile hand set or other mobile access device that is in working order and suitable for use in connection with the Service. You are responsible for ensuring that your equipment and/or software do not disturb or interfere with Company's operations. Any equipment or software causing interference shall be immediately disconnected from the Service and Company shall have the right to immediately terminate this Agreement. If any upgrade in or to the Service requires changes in your equipment or software, you must effect these changes at your own expense. For example, our information security policies: Govern retention of sensitive information; Restrict access to information systems; and Specify password requirements. Our practices and procedures meet the highest standards. Further, we share only the information we believe is needed to offer a product or service efficiently. Finally, we restrict the use of such information and require that it be kept secure. b) Information We Collect to Conduct Our Business: We collect information about you to conduct our business and deliver the top quality service you expect. Sources include: Information we receive from you. Information we receive from third parties, such as points awarded to the PrizePlay.com program as a result of your transactions with your games or redemptions fulfilled. c) Information Shared Within PrizePlay: We may share information we collect regarding your redemptions with our customer service agents including: Identification information (such as name and address); Transaction and experience information (such as redemptions and points awarded); d) Information Shared Outside of PrizePlay: We may share shipping or redemption information we collect with the following types of companies: Fulfillment companies that are shipping rewards directly to you. We do not share any other information about you. We do not supply any information about you, your account, or your PrizePlay.com point balance to any other marketing, advertising, or direct marketing entities. e) Updates and Additional Information: This notice replaces any previous notices from PrizePlay about the privacy, security, and protection of information. You may have other privacy protections under state laws. We may amend this privacy notice at any time. We will inform you of changes as required by law. f) Tips to Protect Your Information: PrizePlay works hard to keep your information secure. You can help by following these tips to protect your information: Store personal information in a safe place and tear up or shred old receipts and account statements before throwing them away. Protect your passwords. Do not share them with anyone unless it's for a service or transaction you request and you are confident the other party will protect the information as you would. g) Email Addresses: If you supply us with your e-mail address, we may let you know by e-mail about special marketing offers for rewards that may be of interest to you. When we collect your e-mail address, and with each special marketing offer e-mail message we send, we will provide you with the opportunity to tell us that you do not wish to receive special marketing offer messages from us in the future. h) Internet Security: PrizePlay uses encryption technology to protect certain information sent over the Internet. SSL is an encryption technology known as "Secure Sockets Layer". SSL encrypts transmissions between two parties and verifies the Web site server you are communicating with. An "s" after the "http" in a web site's address indicates that you are attached to a secure server using SSL technology. Additionally, if your browser is Microsoft Internet Explorer 3.0, Netscape Navigator 4.0, or a higher version of either, a picture of a lock or a key should appear in the lower right hand corner of the browser's window. i) Use of Cookies: The PrizePlay.com rewards web site may use a feature of your Internet browser called a cookie. Cookies are files placed within your browser on your computer's hard drive by a web site server. The PrizePlay.com Rewards web site may use cookies to facilitate your Internet sessions, to maintain security and to improve our web sites. For example, PrizePlay uses cookies to verify your identity, remember your personal settings such as your offer preferences, and to monitor your use of the PrizePlay.com rewards web site to improve our services. If you choose not to enable cookies on your browser, you will not be able to use some of the services offered on the PrizePlay.com rewards web site. j) Children: The PrizePlay.com rewards web site is not directed to children under age 16 and PrizePlay does not knowingly collect personal information from children under age 18. The User is solely responsible for any prize redemption and the use of the PrizePlay.com rewards web site. k) To Further Protect Your Privacy: While exploring the services offered through the PrizePlay.com rewards web site, please be aware that other online partners' services accessible through PrizePlay web sites, have separate privacy and data collection policies and practices, which are independent of and may be different from PrizePlay policies and practices. PrizePlay is not responsible or liable for these independent policies and practices and it is your responsibility to review them and decide whether or not they satisfactorily protect your rights. l) Policy Amendments: These Internet Privacy Practices were last updated June 30, 2005 and update and replace any previous Internet Privacy Practices from PrizePlay. Accounts: By downloading a PrizePlay game you agree to allow Sennari Entertainment to establish an account in your name based on your mobile phone number. The establishment of an account and/or the participation in any game or tournament confirms your acknowledgement of and agreement to be bound by Sennari Entertainment, Inc., Inc. Terms and Conditions. If you do not agree to these Terms and Conditions, which includes by incorporation our Privacy Policy, you may not access or otherwise use Sennari Entertainment, Inc. or its services. Sennari Entertainment, Inc. may modify these Terms and Conditions at any time. Your continued use of Sennari Entertainment, Inc. following such modifications signifies your acceptance of those modifications. You are responsible for reviewing these Terms and Conditions periodically for any such modifications. 2. Governing Law: These Terms and Conditions are governed by the laws of the State of California, in the United States of America and are subject to interpretation according to said laws. By establishing an account and/or participating in a Sennari Entertainment, Inc. game, promotion you agree that any conflict or disagreement that cannot be resolved by the parties will be resolved individually, without resort to any form of class action. You further agree that the State of California in the United States of America will be the sole jurisdiction for resolving any dispute. 3. Entire Agreement: These Terms and Conditions, in connection with the other obligations and rules detailed in writing on Sennari Entertainment, Inc., constitute the entire agreement between you and Sennari Entertainment, Inc. and cannot be modified by you. As previously stated, Sennari Entertainment, Inc. in its sole discretion has the authority to modify these Terms and Conditions. 4. Severability: If any portion of these Terms and Conditions is deemed void or unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions. 5. Term: The license for Sennari Entertainment, Inc. shall be effective from the date you begin using Sennari Entertainment, Inc. until the date of termination. This license shall terminate automatically when any of the following occur: (i) Sennari Entertainment, Inc. removes the site, or (ii) you fail to comply with the limitations described herein. Further, Sennari Entertainment, Inc. may terminate this license at any time by providing individual or public notice of the intent to terminate. 6. Eligibility: To participate in any game or tournament of Sennari Entertainment, Inc. you must be a natural person and be a registered citizen or resident alien with an address in the country where the PrizePlay© games service is offered. You must be at least 18 years of age and possess the legal authority to enter into an agreement and to use Sennari Entertainment, Inc. games and tournaments in accordance with these Terms and Conditions. If you are between the ages of 16 and 18 you must have parental permission to use any of the services provided by Sennari Entertainment, Inc. You represent and warrant that all registration and account information you supply to Sennari Entertainment, Inc. is complete and accurate and (through timely updates) are responsible for maintaining the accuracy of this information. Deliberately submitting misleading incomplete and/or inaccurate information will result in the elimination of your account and the forfeiture of any funds you may have won or deposited. Every Sennari Entertainment, Inc. player is allowed only one account on our PrizePlay© game network. Sennari Entertainment, Inc. reserves the right to enforce this limitation by requesting a system wide unique mobile phone number, email address and/or credit card number. If it is discovered that any user has circumvented this limitation Sennari Entertainment, Inc. has the right to terminate multiple accounts at any time in order to bring the user into compliance with this limitation. Any prizes, reward points, game tokens, and monies associated with closed accounts are subject for forfeiture. 7. Additional Persons Not Eligible: Notwithstanding paragraph I, Eligibility, the following persons are ineligible to participate in any tournament or receive any prize offered on Sennari Entertainment, Inc.: employees, officers, and directors (and their immediate family members) of Sennari Entertainment, Inc.; its parent companies, subsidiaries, and affiliates; and any other person with access to non-public information regarding the operation of any tournament offered on the Site. For purposes of this section, immediate family members include parents, siblings, spouses, children, or any other person permanently residing in the same household with such employee, officer, or director. 8. Compliance with Law and Taxes: You are subject to all laws of the state, province and/or country in which you reside and from which you access Sennari Entertainment, Inc. and are solely responsible for obeying those laws. You agree that Sennari Entertainment, Inc. cannot be held liable if laws applicable to you restrict or prohibit your participation. Sennari Entertainment, Inc. makes no representations or warranties, implicit or explicit, as to your legal right to participate in any tournament offered on Sennari Entertainment, Inc. nor shall any person affiliated, or claiming affiliation, with Sennari Entertainment, Inc. have authority to make any such representations or warranties. Sennari Entertainment, Inc. reserves the right to monitor the location from which you access Sennari Entertainment, Inc. and to block access from any jurisdiction in which participation is illegal or restricted. 9. Property Rights: By establishing an account and/or participating in any Sennari Entertainment, Inc. game or tournament you are acknowledging that the entirety of Sennari Entertainment, Inc.'s content is the protected property of Sennari Entertainment, Inc. and its licensors. You acknowledge that you are provided access to this information for your own individual use and you agree not to change, sell, publish, participate in the transfer or sale of, create derivative works or in any other way exploit this information for any purposes. 10. Additional Privacy Policy: Sennari Entertainment, Inc. will not intentionally disclose any personally identifying information about you (including your social security number and information regarding your IP address) to third parties, except where Sennari Entertainment, Inc., in good faith, believes such disclosure is necessary to comply with the law or enforce these Terms and Conditions or other rules of Sennari Entertainment, Inc. games. Sennari Entertainment, Inc. may use your username and game or tournament records and winnings in accordance with section VI Promotional Activities (see below). By using Sennari Entertainment, Inc., you signify your acceptance of Sennari Entertainment, Inc.'s Privacy Policy. If you do not agree with this Privacy Policy, in whole or part, please do not use Sennari Entertainment, Inc. To view the full Privacy Policy, click here. 11. Technical Configuration: It is your sole responsibility to confirm the technical compatibility between your mobile phone and/or computer system and the Sennari Entertainment, Inc. services. 12. Promotional Activities: By registering for an account you agree that Sennari Entertainment, Inc. may display your user name and game or tournament records on the site or in publicity emails. By registering with Sennari Entertainment, Inc., you agree to allow Sennari Entertainment, Inc. to print, publish, broadcast and use, worldwide, in any media and at any time, your name, picture, voice, likeness, and/or biographical information for promotional purposes without additional compensation. 13. Anti-Spam Policy Sennari Entertainment, Inc.: Sennari Entertainment, Inc. is against the practice commonly referred to as "Spam". Validated reports of "Spam" will result in the termination or suspension of the offender's account. Prize Substitution: Sennari Entertainment, Inc. reserves the right to substitute a prize of equal or greater value for any prize selected for redemption by you if the prize you selected is not available.
